Can You Help Us with Information on Instructor Contracts?

Q: I wanted to inquire about Community Education Classes - what do you suggest contractual agreement include to cover all legal aspects for an instructor that is seen as a vendor and not a district employee? What is beneficial data reporting in year end reporting with CE courses to provide to school boards? What is suggested payroll process for vendors (CE instructors)? Should the instructors (vendors) invoice? Or payment can solely be done by on-line registrations? Thank you for this information, as my Advisory Board has requested my office provides answers in order to evaluate how our office runs and if it is most effective.

A: Here is some information that you should find useful. The question of vendors is particularly complicated. The IRS has very strict rules about whether or not an instructor is an employee or a contractor. I have attached a report on that which will give you a lot of information to discuss with your advisory board.

That said, if your instructors are NOT employees, they should invoice you for services. Keep in mind that simply invoicing does not establish their legal classification according to IRS regulations.
